In all three cases, the claims of Wendy Jap-A-Joe were dismissed.

The rulings concern the defamation and slander matter against the Raad van Commissarissen (RvC, Supervisory Board), Jap-A-Joe’s legal status as director, and the transfer of TAS’s management and business assets to the RvC. The judgments are provisionally enforceable.

The rulings provide preliminary legal clarity in the conflict that has led to major tensions within the telecommunications authority in recent days. Jap-A-Joe has fourteen days to lodge an appeal.

Three court cases, three rulings

The court heard three separate disputes arising from the governance crisis at TAS.

The first case concerned the accusations of defamation and slander brought by Jap-A-Joe against the Raad van Commissarissen. Her claims were dismissed.

The second case focused on her legal position within TAS. It concerned the question of whether Jap-A-Joe could still claim the position of director despite the expiry of her term of appointment. Her claims were also dismissed in these proceedings.

The third case was brought by the Raad van Commissarissen and concerned the transfer of the organisation. The RvC had demanded that Jap-A-Joe hand over TAS’s business assets, documents, information and other property so that the board could effectively exercise management.

The ruling in this case was also against Jap-A-Joe. The exact obligations arising from the judgment must become clear from the written ruling.

Conflict escalated after expiry of appointment term

The conflict at TAS arose after Jap-A-Joe’s term of appointment as director expired on October 20, 2026. The Raad van Commissarissen took the position that, from that moment, the board was tasked with acting as the organisation’s management.

Jap-A-Joe opposed this. She cited, among other things, an employment contract from 2021 and argued that she could not simply be removed from her position.

The situation escalated when members of the RvC sought access to the TAS building to take over management. This led to confrontations and tensions. According to earlier statements from the RvC, board members were assaulted during the events, after which a police report was filed.

The intended transfer of the organisation could therefore not take place.

Political debate also over TAS leadership

The matter led not only to legal proceedings, but also to political division.

Vice President Ronnie Brunswijk previously stated that Jap-A-Joe could not be removed from her position without a formal resolution. He stressed that she should be able to continue her work as long as there was no legal clarity.

Minister Raymond Landveld of Transport, Communicatie en Toerisme (TCT) defended, on the other hand, the position that the Raad van Commissarissen was authorised to act as TAS management after the expiry of the appointment term.

President Jennifer Simons also commented on the matter. The presidency stressed that the applicable laws and regulations must be decisive in resolving the governance conflict.

Attempt at settlement failed

During the hearing of the summary proceedings on Sunday, October 25, an attempt was still made to reach a solution. However, no settlement was reached between the parties involved.

The RvC maintained its position that it was authorised to manage the organisation and therefore needed access to all necessary business assets and information.

Jap-A-Joe continued to defend her legal position. The court then announced that it would deliver its ruling on Monday.

Judgments immediately enforceable

Importantly, the judgments have been declared provisionally enforceable. This means that the obligations imposed can in principle be carried out immediately, even if Jap-A-Joe decides to appeal.

A possible appeal therefore does not automatically suspend the enforcement of the judgments.

Jap-A-Joe has fourteen days to appeal the rulings.

With the court rulings, a major legal obstacle to the transfer of TAS appears to have been removed. Whether the transfer will actually take place without further problems will become clear in the coming days.

For the time being, the ruling represents an important development in the governance conflict, which has caused considerable unrest both within TAS and at the political level.

The judge has dismissed all claims by Wendy Jap-A-Joe in the management dispute at TAS, allowing the Raad van Commissarissen (Supervisory Board) to take over management and company assets.

{"facebook_29234516172805655_1309923202201307":"","facebook_29234516172805655_1158244960706604":"","facebook_29234516172805655_1093738170500407":"","facebook_29234516172805655_108923581283702":"
[16333
24566,16291,20032,22223,16292,20086,21078
post-197057","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-general","tag-court-case","tag-key-news","tag-nieuws","tag-rvc","tag-suriname","tag-tas","tag-wendy-jap-a-joe
["GET
